Роман Василенко: жилищная кооперация – оптимальный способ решения жилищного вопросаПредседатель правления жилищного кооператива «Бест Вей», доктор экономических наук Роман Василенко убежден, что жилищная кооперация – оптимальный инструмент решения жилищной проблемы россиян - Роман Викторович, как быстро можно приобрести квартиру с помощью ЖК «Бест Вей»? - Сейчас средний период ожидания составляет примерно шесть месяцев. Кооператив был создан в 2014 году. В 2018 году мы приобрели более 600 квартир. ЖК — это, по сути, касса взаимопомощи: речь идет о покупке жилья в рассрочку, а не в кредит. Собирается несколько пайщиков и в складчину приобретает жилье для одного. Потом начинаются возвратные выплаты от того, кому уже купили квартиру, кроме того, могут прийти новые пайщики, так копится сумма на покупку квартиры для другого, затем для третьего и т.д. Очередь до второго или до третьего дойдет тем быстрее, чем больше пайщиков придет в кооперативе и чем больше будут возвратные выплаты от тех, кому уже купили квартиру. Причем сумма, составляющая долю самого пайщика в покупке квартиры для него, может постепенно аккумулироваться на счете кооператива. - А в чем преимущество жилищного кооператива? - 70% российских семей не могут себе позволить себе ипотечное кредитование. Значительная часть из тех, кто нуждается в жилье, даже и не обращаются в кредитные организации: проблемы с кредитной историей, нет официальной работы, официальные доходы не те, что требует банк, нет постоянной прописки… А из тех, кто обращается, большинство получает отказ. По данным Счетной палаты РФ, более четверти средств, выделенных для жилищного субсидирования молодых семей из бюджета, оказались невостребованными, так как семьи не могут получить кредит. Следующее препятствие – кредит вам могут одобрить совсем не на ту сумму, которая вам необходима. И вы будете вынуждены покупать ту квартиру, которую сможете себе позволить на предоставленные деньги. Как работает жилищный кооператив? Для приобретения объекта недвижимости с помощью ЖК «Бест Вей» член кооператива вносит – единовременно или постепенно 35% от стоимости объекта жилой недвижимости, 65% вносит кооператив – и приобретается квартира. Кроме того, финансирование со стороны ЖК очень демократично: мы не проверяем кредитную историю, покупателем квартиры может быть абсолютно любое лицо, не зависимо от того, есть ли у него официальная работа или нет, были у него просрочки по кредитам или нет. Мы предоставляем максимально удобный график платежей – дифференцированный. Пайщик должен полностью расплатиться с нами за 10 лет. Могут предоставляться платежные каникулы. Учитывая то, что значительная часть наших сограждан постоянно рискует лишиться стабильных доходов, это оптимальная модель расчета за купленную квартиру. - А если пайщик окажется мошенником или переоценит свои финансовые возможности? - Финансовая безопасность кооператива обеспечивается тем, что на период расчета за средства, предоставленные кооперативом, квартира находится в собственности кооператива. Если член кооператива по различным причинам выходит из кооператива или исключается из него, паевой взнос полностью возвращается пайщику. Квартира либо передается другому пайщику, либо реализуется на открытом рынке. - При ипотечном варианте право собственности сразу оформляется за гражданина. - Да, но это собственность под обременением – под залогом! К тому же вы можете в любой момент эту так называемую собственность потерять вместе с вложенными деньгами. Или вследствие неплатежеспособности по инициативе банка. Или из-за того, что на объект недвижимости может быть обращено взыскание третьими лицами. Если пайщик кооператива систематически не исполняет свои обязательства перед кооперативом по внесению ежемесячных платежей, решением общего собрания пайщик исключается из числа членов кооператива, при этом внесенные им ранее паевые средства возвращаются ему в полном объеме. - Как работаете с квартирой? - Мы очень тщательно проверяем объекты жилой недвижимости, которые приобретаем в интересах пайщика, в том числе их ликвидность. Проводится юридическая экспертиза правоустанавливающих и технических документов, предоставленных продавцом объекта недвижимости. Проводится независимая оценка рыночной стоимости объекта недвижимости. Для ЖК важны гарантии, что объект недвижимости, в который вкладываются деньги, был ликвидный. Кооператив должен понимать: если пайщик окажется неплатежеспособным, сможет ли ЖК эту квартиру передать другому пайщику или продать на открытом рынке. Это для нас фактор безопасности: не потерять деньги пайщиков. - Каков правовой статус квартиры и пайщика, для которого она приобретается? - До момента полного погашения средств, предоставленных кооперативом, собственник квартиры -- кооператив. Кстати, в большинстве регионов он как некоммерческая организация освобожден от налога на имущество. Объект недвижимости приобретается целевым образом – для проживания конкретного пайщика и членов его семьи, потому не принимается кооперативом на учет в качестве основных средств. И в момент полного погашения долга за ту часть, которая внесена кооперативом, автоматически становится полноценным владельцем квартиры. Пока пайщик расплачивается за долю, внесенную кооперативом, он бесплатно получает квартиру во владение и пользование для себя и членов семьи, прописывается в квартире. - Развитие кооператива зависит от количества привлекаемых пайщиков? - Да, конечно. Но их ахиллесова пята - очередь. Первая квартира обычно покупается быстро, поскольку первую группу пайщиков сформировать не так сложно. Но потом их количество растёт медленно, а возвращаемые суммы недостаточны, чтобы покупать следующие квартиры. К примеру, один из московских ЖК, которому 13 лет, купил всего 104 квартиры. А наш кооператив - 100 квартир за первый год, в настоящее время более 500 объектов. Это объясняется нашей инновационной системой привлечения пайщиков, основанной на использовании механизмов сетевого маркетинга. Пайщики, для того, чтобы быстрее получить жильё, сами привлекают новых пайщиков, и при этом пайщики выступают в качестве консультантов. Чтобы быстрее получить квартиру, человек, вступивший в кооператив, заинтересован в привлечении людей. И здесь срабатывает «сарафанное радио», превращаясь в колоссальную сеть. - Будет ли этот рост вечным? - Предусмотренный уставом ЖК резервный фонд позволяет сохранить устойчивость между привлеченными и использованными паевыми средствами и покрыть разрывы в период, когда пайщик решил добровольно выйти из кооператива и кооператив должен вернуть ему все его паевые взносы, а квартира еще не реализована. - А каково правовое регулирование деятельности жилищных кооперативов? - Жилищный кооператив в соответствии с пунктом 4 статьи 110 ЖК РФ -- потребительский кооператив, признаваемый некоммерческой корпоративной организацией. Это юридическое лицо, которое не преследует извлечение прибыли в качестве основной цели своей деятельности (пункт 1 статьи 123.1 ФЗ «О некоммерческих организациях»). Все пайщики вносят вступительный, членские и паевые взносы. Наш ЖК согласно Уставу вправе: во-первых, использовать денежные средства пайщиков на приобретение объектов недвижимости в их интересах. Во-вторых, покупать для пайщиков по их выбору объекты недвижимости на первичном и вторичном рынке недвижимости на территории Российской Федерации. В-третьих, ЖК предоставляет пайщикам объекты недвижимости в пользование на основании акта приема-передачи после приобретения ЖК прав собственности на данные объекты недвижимости. Пайщики имеют право зарегистрироваться по месту жительства на купленных для них ЖК объектах недвижимости. Информация о кооперативе «Бест Вей» раскрывается на нашем сайте https://bestwaycoop.com/. - Можно ли говорить о том, что жилищная кооперация -- надежный и выгодный способ приобретения жилья на сегодняшний день? - При масштабировании, при государственной поддержке -- безусловно. В Германии, например, финансирование покупки квартир происходило и происходит преимущественно с помощью так называемых строительно-сберегательных кооперативов – кстати, с частичным государственным финансированием. - Как вам пришла в голову идея создать ЖК? - Я долго думал, что можно предложить нужное людям, что будет востребовано и почти не имеет конкуренции среди потребностей? Жилье – вне конкуренции. - Как широко работает «Бест Вей»? - Мы работаем в России, аналогичные кооперативы с автономными бухгалтериями зарегистрированы в Казахстане и Киргизии. Наши офисы располагаются в городе Санкт-Петербург, Нур-Султан и Бишкек. - Что мешает развитию жилищных кооперативов? - Недостаточная поддержка со стороны государства. Нужна поддержка, так сказать, вербальная — как полезного для страны явления. Плюс устранение пробелов в законодательстве — появление особого правового статуса для жилищных кооперативов. Это повысит привлекательность нашей сферы. Пенсионный фонд часто отказывает в перечислении в качестве паевого взноса материнского капитала. Ссылаясь на внутренние распоряжения, ПФР требует точный адрес объекта и конкретный срок приобретения жилья. Однако дело в том, что объект недвижимости пайщик выбирает после внесения им 35% от заявленной стоимости жилья и когда будут собраны средства для приобретения жилья пайщику, которые многие из них и хотят профинансировать за счет материнского капитала. В настоящее время ЖК «Бест Вей» участвует в разработке законопроекта о жилищной кооперации под эгидой фракции «Справедливая Россия». Это очень важный для России закон, который позволит развить жилищную кооперацию в нашей стране.

The Democratic wins by candidates with sharp ideological differences will do little to settle the party’s long-raging internal debate about its way forward, with a host of competitive midterm primaries just months away and the 2028 presidential primary already looming.

But their campaigns had some things in common. Though their solutions were different, the candidates focused on the issue of affordability. And they were all fiercely critical of Trump’s performance.

“It’s not just a message about Democrats; it’s a message about our entire country. I think Americans are appalled by what they are seeing coming out of this administration,” New York Rep. Alexandria Ocasio-Cortez said on CNN from Mamdani’s victory party.

In California, voters approved by a wide margin a redistricting ballot measure intended to boost Democrats’ chances in next year’s battle for control of the House. And in Pennsylvania, Democratic state Supreme Court justices won their retention votes, allowing Democrats to keep their majority on the high court in a perennial battleground state where legal challenges over voting rules are all but certain.
